At each stage of life: reaching adulthood, marriage, birth of a child, divorce, disease or death, it is wise to look at your Estate Plan. If you became incapacitated, who would make your medical and financial decisions? Despite what many people think, it is not automatically your spouse. When you die, will your assets go where you think they will and how much money (taxes and attorney fees) will it cost to get them there? Probate is the court procedure through which and upon your death, your Will is admitted, a personal representative is appointed, and your estate is administered. Trusts Often times Revocable Living Trusts are established and funded prior to death to avoid the probate procedure. Beware, trust administrations can also be complicated and the advice of an attorney should be sought. The most common trust, a Revocable Living Trust, is a trust document that can be created to hold your assets while you are living and that transfers them upon your death. Avoidance of probate is the most common reason voiced by individuals who utilize a Trust rather than a Will to disburse their assets at their death. However, there are other reasons why a Trust may be preferred to a Will; such as, privacy, no immediate family to inherit out-of-state real estate, tax savings, minor or disabled beneficiaries. Trusts can be used by individuals or married couples. Although trusts cost more to establish, at your death a trust administration can save you costs and fees. By the time you are in your 60's, it is possible that you will start providing some kind of care for an aging parent or other relative. Making sure they are safe and healthy can be a big undertaking. My passion and compassion for the Elderly started when I was a child. I was very close to my two Great Aunts who never married. At age 10, I would spend Saturdays in my Aunt Violas beauty shop washing curlers and talking with the older ladies. At age 22, while in Law School, I cared for my Great Aunt Anita in her own home. I coordinated 24 hour care for her, planned her meals, took care of her home and her medical needs for six years and I was with her when she died - six months after our first child was born.
